Pauls Travel Solutions Pty Ltd (ABN 26 624 441 416) and its branded entities (Pauls Holidays, trvlr, flyght) (collectively “Pauls Travel”, “we”, “us”, “our”) operate websites including paulstravel.com.au, flyght.com.au, paulsholidays.com.au, and trvlr.com.au (“our sites”).
These Terms of Use (“Terms”) govern your access to and use of the website at paulstravel.com.au (the “Website”) and any related services provided by Pauls Travel Solutions Pty Ltd (ABN 26 624 441 416) (“Pauls Travel”, “we”, “us”, “our”).

1. About Pauls Travel
Pauls Travel is an Australian-based travel agency. We arrange and facilitate travel-related products and services on behalf of third-party providers such as airlines, hotels, cruise lines, tour operators, transport providers, travel insurers and other suppliers (“Travel Suppliers”).
Except where expressly stated, we act as an agent for Travel Suppliers and do not operate flights, own hotels, or provide the underlying travel services. Your contract for travel services is generally with the relevant Travel Supplier, not with us.
2. Use of the Website
2.1 Licence to use
We grant you a limited, non-exclusive, non-transferable licence to access and use the Website for your personal, non-commercial use in connection with researching and booking travel.
You must not:
- Use the Website for any unlawful purpose or in any way that breaches any applicable law or regulation.
- Attempt to interfere with, compromise the security of, or damage the Website or any systems or networks connected to it.

4. Bookings and agency role
4.1 Agency relationship
When you book through Pauls Travel:
- We act as your agent and/or as an agent for the relevant Travel Supplier.
- We facilitate your booking and arrange contracts between you and the Travel Supplier.
- Your legal rights in relation to the travel services themselves are primarily against the Travel Supplier, not us, except to the extent we are directly at fault.
4.2 Travel Supplier terms
All bookings are subject to the terms and conditions, fare rules, and policies of the relevant Travel Supplier (including conditions of carriage, cancellation policies, and baggage rules).
You acknowledge that:
- Travel Suppliers may change or cancel services in accordance with their own terms.
- We are not responsible for changes or cancellations made by Travel Suppliers, except where caused by our negligence or breach of these Terms.
- You should carefully review the Travel Supplier’s terms before booking. We can provide copies on request.
5. Prices, payments and fees
5.1 Prices
- Prices shown on the Website are indicative only and subject to availability and change without notice.
- Prices are not guaranteed until your booking is confirmed in writing and paid in full.
- Price changes may occur due to currency fluctuations, fuel surcharges, tax changes, supplier price increases, or other factors outside our control.
5.2 Payments
- You must pay all amounts due by the deadlines advised at the time of booking.
- Failure to pay by the due date may result in automatic cancellation of your booking and loss of any deposit.
- We accept payment by methods advised at the time of booking (e.g. credit/debit card, bank transfer, BPAY).
Credit/debit card payments may incur a surcharge to cover processing costs. The applicable surcharge will be disclosed before you pay.
5.3 Booking and service fees
We may charge reasonable booking, service, change, or cancellation fees to cover our time, systems, and administrative costs. These fees will be disclosed to you before you confirm your booking or service.
6. Changes, cancellations and refunds
6.1 Changes or cancellations by you
- If you wish to change or cancel your booking, you must contact us as soon as possible.
- Change and cancellation fees will apply, including:
- Our reasonable service fees; and
- Any fees, penalties, or losses charged by the Travel Supplier (which can be up to 100% of the booking value).
- Some fares and rates are non-refundable and may not permit changes.
6.2 Changes or cancellations by Travel Suppliers
If a Travel Supplier changes or cancels your booking:
- The Supplier may offer alternative arrangements, a travel credit, or a refund in line with its terms.
- We will assist you in liaising with the Supplier, but any refund or credit is subject to the Supplier’s policy and our receipt of funds from them.
- We are not liable for the Supplier’s decision to change or cancel, except where caused by our negligence.
6.3 Refunds
Where a refund is due:
- We will process it in accordance with the Travel Supplier’s rules and once we have received the funds from the Supplier.
- We may deduct our reasonable service fees and any non-refundable Supplier charges.
- Refund timeframes depend on the Supplier and payment method and can take several weeks.
Nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL) in relation to refunds and remedies where a statutory guarantee has not been met.
7. Passports, visas, health and entry requirements
It is your responsibility to:
- Hold a valid passport (usually with at least six months’ validity beyond your return date).
- Obtain all required visas, permits, and travel authorisations (e.g. ESTA for the USA).
- Comply with all entry, transit, health, and vaccination requirements for your destinations.
- Check travel advisories issued by the Australian Government at smartraveller.gov.au.
We can provide general guidance and refer you to visa and health information services, but:
- We do not guarantee the accuracy of this information.
- We are not responsible if you are denied boarding or entry due to incorrect or missing documentation or failure to meet health requirements.
8. Travel insurance
We strongly recommend that you purchase comprehensive travel insurance at the time of booking, covering cancellation, medical expenses, repatriation, baggage, and personal liability.
We are an authorised representative of certain travel insurance providers and may receive commissions or other benefits when you purchase insurance through us. We will provide you with the relevant Product Disclosure Statement (PDS) and Financial Services Guide (FSG) before you decide to purchase.
You should read the PDS carefully to ensure the product meets your needs. We do not guarantee that any particular claim will be accepted by the insurer.
9. Special requirements, dietary needs and accessibility
If you have special requirements (including medical needs, mobility aids, dietary restrictions, or accessibility requirements):
- You must advise us at the time of booking.
- We will pass your requests to the relevant Travel Supplier, but we cannot guarantee they will be met.
- It is your responsibility to confirm directly with the Supplier that your needs can be accommodated.
10. Loyalty programs and frequent flyer points
If you are a member of a frequent flyer or loyalty program:
- Provide your membership details at the time of booking.
- We will pass these details to the relevant Supplier where possible.
- We do not guarantee that points, status credits, or benefits will be credited to your account.
- Any issues with points or benefits must be resolved with the relevant program operator.
11. Conduct and user obligations
You agree not to:
- Use the Website in any way that causes, or may cause, damage or impairment to the Website or its availability.
- Use the Website to transmit viruses, malware, or any harmful code.
- Attempt to gain unauthorised access to any part of the Website or related systems.
- Use the Website to defraud, mislead, or engage in any illegal activity.
We may report suspected unlawful or abusive activity to relevant authorities and cooperate with investigations.

Where we are liable for a failure to comply with a non-excludable statutory guarantee, our liability is limited (to the extent permitted by law) to:
- Resupply of the services; or
- Payment of the cost of having the services supplied again.
14.2 Other liability
To the maximum extent permitted by law:
- We are not liable for any indirect, special, incidental, or consequential loss or damage (including loss of profits, business, or data) arising out of or in connection with your use of the Website or any travel bookings, except where such liability cannot be excluded by law.
- We are not liable for any act, omission, or default of any Travel Supplier (including airlines, hotels, cruise lines, and tour operators) over whom we have no control.
- Our total liability to you for any claim arising out of or in connection with the Website or our services (other than for personal injury or death caused by our negligence) is limited to the amount of fees you paid to us for the specific booking or service giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Australian law.
15. Force majeure
We are not liable for any failure or delay in performing our obligations (including providing services or processing bookings) to the extent that such failure or delay is caused by events beyond our reasonable control, including:
- Natural disasters, extreme weather, fire, or flood.
- Epidemics, pandemics, or public health emergencies.
- War, terrorism, civil unrest, or industrial action.
- Government actions, travel bans, border closures, or changes in law.
- Technical failures, cyber-attacks, or disruptions to communications or payment systems.
In such circumstances, we will use reasonable efforts to minimise the impact on your travel and to assist with alternative arrangements where possible.
